The Eastern District of California, Yosemite Courthouse, offers the opportunity for a defendant to receive traffic school.
However, you WILL NOT QUALIFY for traffic school if ANY of the following apply:
|
1) |
You have attended/completed any form of traffic school due to a vehicle code moving violation at any time within 18 months prior to the date of the offense in this case; |
2) |
You possess a commercial driver’s license; |
3) |
The offense in this case was for driving more than 25 miles over the posted speed limit; OR |
4) |
The offense in this case involved alcohol or a controlled substance. |
|
|
You must also review and understand and agree to comply with the procedures for traffic school. |
|
YOU ALWAYS HAVE A RIGHT TO PLEAD NOT GUILTY AND RECEIVE A TRIAL or PAY THE FINE LISTED ON YOUR VIOLATION NOTICE. |
Once you fully complete the information below, please click the "Submit Form" button at the bottom of the page. In order to ensure timely processing of your request before your scheduled court date, you must submit this form at least 2 weeks prior to your scheduled court date. Most importantly, if you do not receive an Order from the Court approving your traffic school request before your scheduled court date, then you must appear at court on the scheduled date and time or pay the fine listed on the violation notice. A failure to appear at the court date or pay the fine listed may result in a warrant issued for your arrest and/or, if a moving violation, an abstract of judgment (a hold) placed on your driving record.
PLEASE NOTE THAT THE GOVERNMENTAL AGENCY THAT ISSUED YOUR DRIVER’S LICENSE IS THE ULTIMATE DECISION MAKER AS TO WHETHER YOU RECEIVE CREDIT FOR TRAFFIC SCHOOL. ONE MUST CHECK WITH THEIR JURISDICTION TO DETERMINE ELIGIBILITY. PLEASE NOTE THAT DIFFERENT STATES HAVE DIFFERENT RULES FOR ALLOWANCE OF TRAFFIC SCHOOL. THIS PROCEDURE IS MERELY A METHOD BY WHICH TRAFFIC SCHOOL IS CONDUCTED IN FEDERAL COURT AND MUST NOT BE USED AS A BASIS TO DETERMINE ELIGIBILITY BY YOUR ISSUING STATE. |
