All Social Security Practitioners

In cases filed after June 15, 2021, or as otherwise ordered by the court, the Eastern District of California will be adopting new procedures in Social Security Cases. Changes will be included in a new Social Security Scheduling Order that will be issued in any case that has not yet been scheduled on or after June 15, 2021. The order will include the new provisions:

*       Court e-service for the Commissioner of Social Security.

*       Elimination of the informal briefing process historically required in the Fresno Division.

*       Requirement that the administrative record be filed within 90 days after the e-service of the complaint.

*       Requirement the plaintiff's motion for summary judgment be filed within 45 days of the filing of the administrative record.

*       Requirement the opposing brief to be filed within 45 days of the filing of the motion for summary judgment and require the reply to be filed within 15 days thereafter.

 

These requirements will apply districtwide.
