CRIMINAL CALENDAR

Judge Nunley's criminal law and motion calendar is held in-person on Thursdays at 9:30 a.m., in Courtroom 2, on the 15th floor. Hearing dates are not reserved. Please check with the Courtroom Deputy for available dates.

NO MATTERS ARE CONTINUED WITHOUT THE JUDGE’S PRIOR CONSENT. 

AFTER TWO STIPULATED CONTINUANCES, THE COURT REQUIRES PERSONAL APPEARANCES FOR STATUS CONFERENCES UNLESS GOOD CAUSE IS SHOWN AND ALL APPLICABLE LAWS SUPPORT LONGER INTERVALS.  FOR ANY CONTINUANCE TO BE EFFECTED, THE COURT MUST APPROVE A WRITTEN REQUEST FOR CONTINUANCE IN ADVANCE OF THE HEARING.

ANY REQUESTS TO CONTINUE JUDGMENT AND SENTENCE MUST BE MADE BY THE PARTY REQUESTING THE CONTINUANCE AND STATE WITH PARTICULARITY THE REASONS FOR THE REQUEST. THE COURT WILL NO LONGER BE CONTINUING JUDGMENT AND SENTENCINGS ABSENT COMPELLING REASONS FOR THE CONTINUANCE. 

  • Stipulations/Proposed Orders:  Stipulation and proposed orders submitted for the Court’s consideration should include the date of the last appearance by the parties, explain in detail the reason for the requested continuance and include all language required by law.  When applicable, probation officers shall be included in discussions about continuances.  Stipulations and proposed orders affecting a matter on an upcoming criminal calendar shall be submitted no later than 5:00pm on the Monday prior to a Thursday hearing date, unless Monday is a holiday, then the deadline is 12:00 PM on the Tuesday prior to the hearing date.   No exceptions will be made.
    • Pursuant to Local Rule 137(b), regarding the requirements for proper filing of a proposed order, you are required to email the proposed order (in Microsoft Word) to chambers at tlnorders@caed.uscourts.gov, in addition to filing the PDF version via the CM/ECF system.  Pursuant to Local Rule 101, the definition for electronic signature, and Local Rule 131, you may enter /s/ for signatures for all counsel.
  • Sentencing Memorandum and Responses: If any party wishes to file a sentencing memorandum in advance of imposition of judgment and sentencing, said memorandum shall be filed on or before 5:00 PM on the Thursday prior to the hearing date.  Any response thereto shall be filed on or before 5:00 PM, on the Monday prior to the hearing date, unless Monday is a holiday, then the deadline is 12:00 PM on the Tuesday prior to the hearing date.  The parties are cautioned that if any sentencing memoranda is filed late, the judgment and sentencing date may be vacated and the matter continued.
  • Motions and Paginations of Exhibits: The Court has placed page limits as follows: twenty (20) pages on all initial moving papers, twenty (20) pages on oppositions, and ten (10) pages for replies.  The parties are not to file multiple or supplemental briefs to circumvent this rule. 
  • Rule 17(c) Subpoena Requests: Unless the Court orders otherwise, these requests should be submitted to the duty magistrate judge.
  • Rule 17(b) Subpoena Requests:  These requests should be submitted to Judge Nunley with supporting documentation of necessity.
  • Interpreter Services
    • It is the responsibility of counsel to arrange for the services of an interpreter prior to the scheduled hearing date. 
    • It is also the responsibility of counsel to cancel the services of an interpreter prior to the scheduled hearing date.
    • Interpreter services for a hearing may be arranged by contacting Yolanda Riley-Portal with the Court’s Interpreter Office, at 916-930-4221 or YRiley-Portal@caed.uscourts.gov.
  • Sealing: No document will be sealed, nor shall a redacted document be filed, without the prior approval of the Court.  All requests to seal or redact shall be governed by Local Rules 141 (sealing) and 140 (redaction).
    • Pursuant to Local Rule 141, a Notice of Request to Seal Documents shall be filed electronically.  The Request to Seal Documents, a proposed order (in Microsoft Word), and all documents covered by the request shall be emailed to tlnorders@caed.uscourts.gov.
