PLEASE NOTE: The court’s procedure has been modified since June 15, 2021 for all judges and Social Security actions. 

New deadlines are listed below. Updated April 16, 2025.

In cases filed after June 15, 2021, or as otherwise ordered by the court, the Eastern District of California will be adopting new procedures in Social Security Cases. Changes will be included in a new Social Security Scheduling Order that will be issued in any case that has not yet been scheduled on or after June 15, 2021. The order will include the new provisions:

·   Court e-service for the Commissioner of Social Security.

·   Elimination of the informal briefing process historically required in the Fresno Division.

·   Requirement that the administrative record be filed within 90 days after the e-service of the complaint.

·   Requirement the plaintiff's motion for summary judgment be filed within 45 days of the filing of the administrative record.

·   Requirement the opposing brief to be filed within 45 days of the filing of the motion for summary judgment and require the reply to be filed within 15 days thereafter.

These requirements will apply districtwide.

 

New Deadlines updated April 16, 2025:

·   Within 60 days of service of the complaint, the Commissioner shall file a copy of the administrative record, which shall be treated as an answer to the complaint unless a separate answer is filed;

·   Plaintiff’s motion for summary judgment is due within 30 days after service of the administrative record;

·   The Commissioner’s crossmotion for summary judgment is due within 30 days after service of plaintiff’s motion; and

·   Plaintiff’s optional reply brief is due within 14 days after filing of the Commissioner’s crossmotion.
